Competition Overview:

  1. The following Terms and Conditions govern the “Pushys YT Capra Core 5 MTB” competition that is being promoted by the Promoter.
  2. Information on how to enter forms part of the Terms and Conditions. Entry into the Pushys YT Capra Core 5 MTB Giveaway (Promotion) is deemed to be an acceptance by the entrant of these Terms and Conditions.
  3. The Promoter is Adventure Online Pty Ltd (ABN 38 650 576 195) trading as Pushys of 31 Gravel Pit Road, Darra, Queensland 4076.
  4. The Promotion commences 8:00 AM AEST 8/11/2024 and closes 11:00 PM AEST 13/12/2024 (Promotion Period).
  5. The relevant licenses and permits for this Promotion is as follows:
    1. SA – T24/1929
    2. ACT – TP 24/02522

Registration and Eligibility:

  1. Entry is open to residents of Australia of 18 years old or over in all eligible states/territories who fulfil the method of entry requirements.
  2. Employees and the immediate families of the Promoter and organisations or agencies associated with or benefiting from the Promotion are ineligible to enter.
  3. Immediate families means any of the following:
    1. spouse;
    2. ex-spouse;
    3. de-facto spouse;
    4. child or stepchild (whether natural or by adoption);
    5. parent;
    6. stepparent;
    7. grandparent;
    8. step-grandparent;
    9. uncle;
    10. aunt;
    11. niece;
    12. nephew;
    13. brother;
    14. sister;
    15. stepbrother;
    16. stepsister; or
    17. 1st cousin.
  4. To enter the Promotion, the entrant must:
    1. place an order with the Promoter during the Promotion Period:
      1. each order of an amount equal to or greater than $149.99 will be deemed as 1 entry;
      2. 1 entry per order will automatically be added at the checkout; and
      3. the entrant will only receive 1 entry per order,
    2. orders may be placed with the Promoter by either online purchase(s) through www.pushys.com.au or in the showroom located in Darra, Brisbane or Fyshwick store, ACT; and
    3. at the time of placing its order register a current, valid and ‘opt-in’ email address with the Promoter (Registered Email), along with a current valid Australian phone number (Registered Phone Number).
  5. An order for multiple items exceeding $149.99 will comprise one single order and one entry.
  6. Multiple orders will entitle the entrant to a corresponding number of entries, subject to the conditions in clause 4 above.
  7. Orders are deemed to be received at the time of receipt by the Promoter.
  8. Orders received outside of the Promotion Period will not be accepted as entries into the Promotion.
  9. Unknown, incomplete, indecipherable orders will be deemed invalid.
  10. Where an order is subsequently cancelled by the entrant and/or a refund and return is processed for that order, the Promoter reserves the right to cancel the entry/s associated with that order.
  11. Records of the Promoter are final and conclusive as to time of receipt and validity of the order and entry to the Promotion.
  12. Incomplete, fake, indecipherable or illegible email addresses and phone numbers will not be accepted and deemed to be invalid.
  13. The Promoter reserves the right to cancel the entry/s associated with any invalid email address or phone numbers.
  14. Records of the Promoter are final and conclusive as to whether an entrant has a Registered Email and Registered Phone Number.
  15. In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered.
  16. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
  17. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions.
  18. The Promoter and its associated agencies or companies accept no responsibility for any lost or misdirected entries.
  19. Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will be void.
  20. If for any reason the Promotion is interfered with in any way or is not capable of running as planned due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right in its discretion, to the fullest extent permitted by law to:
    1. modify suspend, terminate or cancel the Promotion as appropriate, subject to approval of the gaming authorities in each State and Territory where relevant; or
    2. disqualify any entrant.

Draw:

  1. One (1) entry will be drawn at random and one (1) winner will be announced at 2:00 PM AEST on the 20/12/2024.
  2. The draw will take place at 31 Gravel Pit Road, Darra, Queensland 4076.
  3. The winner will then be emailed and phoned by 27/12/2024.
  4. The winner is not required to be present during the draw.
  5. The winner for the prize draw will be awarded YT Capra Core 5 29in Carbon Black Magic Medium MTB (Prize).
  6. The total prize pool for the Promotion is RRP of $7,999.99 AUD.
  7. The Prize must be taken as offered, and is not transferable or exchangeable by the winner for cash or any other prize, unless otherwise specified in writing by the Promoter (in their absolute discretion).
  8. Once awarded, the Promoter is not liable for the Prize if it has been lost, stolen, damaged or tampered with in any way.
  9. The winner will be notified by phone within 7 days of the prize draw (and where required will be notified in writing to their advised email and/or delivery address) and their Prize will be issued within 7 days of the Promoter notifying the winner (and verifying validity of their entry).
  10. The winner’s last name, first initial and postcode for each draw will be published on the Promoter’s website at www.pushys.com.au within 30 days of the date of the draw.
  11. The winner’s name will also be published in the following newspapers:
    1. The Australian
    2. ACT – The Canberra Times
    3. NT - NT News
  12. The winner may request that their name and postcode not be published.
  13. Subject to the unclaimed prize draw clause, if for any reason a winner does not claim, accept or take delivery of the Prize for any reason within 10 business days from the announcement of the winner then the Prize will be forfeited.
  14. The Promoter may conduct such further draws as are necessary for any unclaimed prizes on 13/01/2025 at the same time and place as the original prize draw, subject however to any directions given by any applicable gaming authorities.
  15. The winner of any unclaimed prize draw will be notified within 7 days of the unclaimed prize draw (in writing), and their last name, first initial and postcode will be published on the Promoter’s website at www.pushys.com.au within 30 days of the unclaimed prize draw.
  16. If the Prize (or portion of the Prize) is unavailable the Promoter reserves the right to substitute the Prize (or that portion of the Prize) to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.
  17. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.

Other Conditions:

  1. The Promoter accepts no responsibility for any tax liability incurred as a result of entering and participating in the Promotion and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
  2. Any tax liability arising as a result of accepting any Prize is the responsibility of the winner.
  3. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  4. Entrants consent (except to the extent that the entrant may otherwise notify to the Promoter) to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for a period of up to 24 months from the date that the winner is announced, without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  5. The Promoter collects personal information (including email addresses and phone numbers) in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities.

  7. Entry is conditional on providing this information.
  8. By entering the Promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being entered into a database and, in addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may use this information in any media for future promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant, without any further reference or payment or other compensation to the entrant.
  9. All personal details of the entrants will be stored at the office of the Promoter.
  10. A request to access, update, opt out or correct any information should be directed to that office. Any complaints regarding the treatment of personal information should also be directed to that office and will be dealt with by the Promoter in accordance with its Privacy Policy.
  11. All entries become the property of the Promoter.
  12. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  13. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute.
  14. The Promotion and the terms in the condition of entry will be governed by Australian Law and any disputes will be subject to the exclusive jurisdiction of the courts of the respective states and territories in which the claim is made.
  15. This Promotion is in no way sponsored, endorsed or administered by, or associated with any social network.
  16. The Provider reserves the right to cancel or amend these Terms and Conditions without prior notice, subject to any notice that must be provided to a regulatory authority.
  17. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
  18. By entering into this competition, an entrant is indicating his/her agreement to be bound by these Terms and Conditions.

  • Only one entry per person is allowed.

    • 3. Competition Period:
  • The competition is ongoing with monthly draws. Each draw takes place on the first Tuesday of every month.

    • 4. Prize:
  • Each month, one winner will receive a $200 voucher.
  • The prize is non-transferable and cannot be redeemed for cash.

    • 5. Winner Selection and Notification:
  • Winners will be drawn randomly on the first Tuesday of each month.

    1. Information on how to enter form part of these Conditions of Entry. Entry into the [Oakley / Suspension Package] (Promotion) is deemed to be an acceptance of these Conditions of Entry.
    2. The Promotion commences [08:00 am AEST 18/09/2024] and closes [11:00 PM AEST 20/10/2024].
    3. Entry is open to residents of Australia. Employees and the immediate families of the Promoter and organisations or agencies associated with or benefiting from the Promotion are ineligible to enter.
    4. To enter the Promotion, the entrant must:
      Place a valid order with the Promoter for Oakley branded products totaling over $79.99 (including GST) during the Promotion Period. Each qualifying order is eligible for one entry, regardless of the total order value above $79.99. Multiple entries are permitted only if separate qualifying orders are placed.
    5. An order for multiple items will comprise one single order and one entry. Multiple orders will entitle the entrant to a corresponding number of entries. Orders are deemed to be received at the time of receipt by the Promoter. Orders received outside of the Promotion Period will not be accepted as entries into the Promotion. Unknown, incomplete, indecipherable orders will be deemed invalid. Where an order is subsequently canceled by the entrant and/or a refund and return is processed for that order, the Promoter reserves the right to cancel the entry/s associated with that order.     6. Incomplete, fake, indecipherable or illegible email addresses will not be accepted and deemed to be invalid.     7. A Random prize draw will occur on 23/10/24 at 31 gravel pit road, Darra at 1:00pm AEST
    8. The Winner for the Prize Draw will be awarded $2,999.00 worth of in stock suspension products of the winners choice. Suspension products can be found here (Prize). The total prize pool for the Promotion is $2999.99 RRP. The prize must be taken as offered, and is not transferable or exchangeable by the winner. If the cost of the chosen items is over $2999.00 additional payment will be required.
    9. The winner will be notified by phone within 7 days of the Prize Draw (and where required will be notified in writing to their advised email and/or delivery address) and their Prize will be issued within 7 days of the Promoter notifying the winner (and verifying validity of their entry). The winner’s name for each Draw will be published on the Promoter’s website within 30 days of the date of the Draw.
    10. Subject to the unclaimed prize draw clause, if for any reason a winner does not claim, accept or take delivery of the Prize for any reason within 10 business days from the announcement of the winner then the Prize will be forfeited.
